Free Florida Month-to-Month Rental Agreement

1. PARTIES

This Florida Month-to-Month Rental Agreement ("Agreement") is entered into on [DATE] by and between [LANDLORD NAME] ("Landlord") and [TENANT NAME] ("Tenant"). The parties agree as follows.

2. PREMISES

Landlord agrees to rent to Tenant the residential property located at [PROPERTY ADDRESS], Florida ("Premises"), including any appliances and fixtures listed in an attached inventory.

3. TERM

This is a month-to-month tenancy commencing on [START DATE]. Either party may terminate with at least 15 days' written notice prior to the end of any rental month, as required by Florida Statute 83.57.

4. RENT

Tenant shall pay monthly rent of $[MONTHLY RENT] due on the 1st day of each month. Late fees of $[LATE FEE] apply after the 5th. Rent is payable to [LANDLORD NAME] at [PAYMENT ADDRESS].

5. SECURITY DEPOSIT

Tenant shall pay a security deposit of $[DEPOSIT AMOUNT] prior to occupancy. Per Florida law (Fla. Stat. § 83.49), Landlord shall return the deposit within 15 days after termination or provide an itemized list of deductions within 30 days if claiming any portion. The deposit will be held in a Florida banking institution and may be commingled.
