Free California Month-to-Month Rental Agreement

1. PARTIES

This California Month-to-Month Rental Agreement ("Agreement") is entered into on [DATE] by and between [LANDLORD NAME] ("Landlord") and [TENANT NAME] ("Tenant"). The parties agree as follows.

2. PREMISES

Landlord rents to Tenant the residential property located at [PROPERTY ADDRESS], California, including any appliances and fixtures listed in Exhibit A.

3. TERM

This is a month-to-month tenancy beginning on [START DATE]. Either party may terminate with 30 days' written notice as required by California Civil Code §1946.1.

4. RENT

Tenant agrees to pay [MONTHLY RENT] per month, due on the 1st day of each month. Rent shall be paid to [LANDLORD NAME] at [PAYMENT ADDRESS].

5. SECURITY DEPOSIT

Tenant shall pay a security deposit of [DEPOSIT AMOUNT], not to exceed one month's rent for unfurnished units per California Civil Code §1950.5. The deposit will be held in a separate interest-bearing account and returned within 21 days after tenancy ends, less any lawful deductions.

6. UTILITIES AND SERVICES

Tenant is responsible for [LIST UTILITIES]. Landlord shall maintain [OTHER SERVICES].
